Crap...

Hey all!! I've been lurking the forums for a while because i have been very interested in the new Fit. We have been planning on buying one once we made enough for the down payment, however everything hasn't gone the way i planned it...

I was driving down to Lake Michigan (I live in Chicago) heading eastbound in our old clunker, lolz Well its a 1988 Toyota Camry that suprisingly only has 116,000 miles on it. When i got hit by a lady in a red 2005 Chevy Aveo >.<

Damage:


Well anyway the Lady admitted fault verbally and gave me her info. However now her insurrence company trying to say that i ate a red light =/

She was still talking on the phone when i got out to see if she was alright!

I found a witness (thank god) Because her insurance doesn't want to pay for any damage.

Well i know that the damage is proboably more than the cars worth, but how much would i be able to get? if i do gte anything...since me and my family need a new car it would go toward a downpayment on the new fit.

Oh and i got a ticket because i cant move the car =/ Apparently towing at night costs $150 i got it towed next day for $40 and found a nice $50 ticket on it =/






Lolz thanks all, and thats my story, might end up good if get the new Fit

And I'll bet this thing gets too good of gas mileage to get the $4500 cash for clunkers deal, huh?

Yeah lolz we were actually excited for the C.A.R.S act but found out this thing got 22MPG

When the other driver is at fault in an accident that occurs on a public road, always have the police write up an accident report which will prevent the other driver's insurance company from trying to wiggle out of paying.

Yeah, I do have a police Report, she is Unit 1. However her insurance "Progressive" suggest they cant prove who is at fault

Get your insurance involved thats what you pay them for,let them fight Progressive for you. Also appeal that ticket by writting a letter of the situation and send in a copy of the accident report. I fight all my tickets some get cleared some dont but I fight them all.

man that sucks you got ticketed for leaving the car there. hopefully everything works out for you

Well i got a witness, the he said the insurance lady was literally interrogating him, even trying to switch the story around. Sides isn't my car worth only like $300?

Should i get a lawyer?

Update

Ok well i got a call from her insurance, they want an estimate and am going to try to get it tomorrow, but how would i go about it? its immobilized...

Kinda new to the whole accident thing.

Get it towed to a body shop that doesnt charge you for an estimate. But dont just go to some Lazos Tacos body shop look for a respectable shop in wich the insurance company will take the estimate seriously. Then once you got the estimate tow the car to ur house and submit the estimate to the insurance.

PS ur gonna have to pay for the tow out of pocket but get a receipt & send a copy of the tow charges with the estimate. GOOD LUCK

I used to have Progressive as well for about 2 yrs. When i was in an accident they handled things great..no problem. But when that same car was stolen (a 2005 Cadillac SRX) they interogated me like a murder suspect and kept calling every few weeks asking more questions.

i Hope you find a good estimate on your car damage!

Status Update:

Insurance is still refusing to pay a dime.
They said just because she left before the police report was made doesn't make it valid.


This is very very EFFN frusterating.Been without a car for the past 2 weeks, and its bulls***

I even called a lawyer he told me "Im sorry guess you're screwed buddy".


So i guess you can hit other ppls cars now and nothing will happen.

you gotta watch those aveo drivers......obviously they don't care about driving or else they wouldn't drive an aveo so they don't care about you either

You could try contacting your state's insurance regulator. I had to do this once. The other driver's insurance suddenly started cooperating.

Sorry to hear about your accident but glad you are OK and able to walk away. Hope you get the thing resolved and can get into a new car hopefully a Fit!

whenever i get into an accident i talk to my agent and let them handle the arguing with the other person's insurance... it makes it move a long quicker for me.

have you spoken to your agent about this and to see what he/she can do to get your car fixed?

Sucks you got into an accident but now you have even more of a reason to get a Fit.
