I made a big mistake buying these 17" rim because reasonable price tires are hard to find.
I am looking for 205/45/17 and many people don't selling used set or even new set would cost me over $400.
I should have bought the 16" rims instead.
not going to lower the car, what other alternative size of tires can I buy?
215/40/17 & 205/40/17 seem to rub, I don't have too many options, do I?

I don't think a 215/40 would rub at all, even a 215/45 shouldn't rub, that's what I would go with if your not going to lower the car at all
I must comment about these tires after 7,500 miles:
1. They handle GREAT! I went to the Dragon about 3 weeks ago and they kicked ass! Going up 1" on the wheel width, increasing the tire width by 20mm and lowering the aspect ration by 5% made a HUGE difference on the Fit. Now I do have stock suspesion but it handled all 318 turns w/o a fuss, infact, it felt like it wanted more and so did I.....MORE TORQUE!
2. They are quiet on the freeway as well as on the street.
3. Looking forward to the snow, well, as much as you can look forward to the snow
While driving the car hard on the Dragon the tires never "yelled at me", just the scuffing sound of the tires turning harder than normal, so I have to say again, they handled the curves great and the tires have the scars to prove it. I did push the car pretty damn hard out there and have slight scarring on the tire shoulder, no biggie though.

I've got a couple friends running my tire now:
1. Mazdaspeed 3
2. Saab 9-5 wagon
3. EVO VIII
By this time next year my buddy with the Saab 9-3 BSR will be putting the Conti DW on his ride as he's got snows (the 9-5 owner above is his wife) I don't wanna see the white stuff fly, but when it does, I'll be ready according to the vid on Tire Rack and reviews I've read about them

if I use the OEM lugs, what will happen?
I check with a local tire shop to buy these special lugs and they don't have clue what I am talking about.....

you are right, Klasse Act
the special lugs cost $50
I find the ride is alot more noisy now, why?

Well, with buying used you never know what your getting, especially with tires. Were they properly rotated and balanced? Was the alignment done right on the previous car? Were they abused?
I checked out your tire and its got a good treadwear rating of 500 but its got 2 large channels on the sides, so that's let's a bit more air to go through there, its got some large tread blocks, so its going to be a bit noiser than most but how do they handle? That's the usual trade off with such tires.
