Order Deposit Refundable?!

Order Deposit Refundable?!

Hello,

I ordered a fit 3 months ago but now no longer whish to purchase it. I was wondering if anyone knows off hand if the deposit is refundable if you ordered the car or if its only refundable if you reserve a car? Any help would be great!

If you signed a purchase contract you might be on the hook, otherwise you might be OK. It may also depend on your particular State laws.

I have a purchase contract infront of me the dealer signed it but I did not...I am almost certain he assured me it was refundable as I ordered it before I could even see what one looked like. SO since my signature isnt on the piece of paper I shouldnt be obligated right?

go and try, cus crap 3 months already? when i decided that i wanted a fit it was in my ownership in 2 days

Just be up front and honest with them, I highly doubt they would screw you like that.

There is no such thing as a "non-refundable deposit". The dealer can't hold onto your money if you did not cause them any loss. There are dozens of buyers who will buy "your" Fit when it arrives at the dealer, so there is no loss by your refusal to purchase. I got my "non-refundable deposit" back with a letter from my attorney inviting the dealer to explain to a judge how he could justify his refusal to refund the deposit. The money was in my mailbox 2 days after the letter from the attorney.

Chris G must lose a LOT of deposits.

..and THAT is exactly what to do if they try and play games. Nice work manx!

You would be "that" guy that threatens someone with a lawyer, and be gun-ho about suing someone.

I wouldnt put a deposit on a car if I wasnt going to buy so, I have never lost money on a deposit.

You signed nothing, I would not even bother to bring the "contract" with me when I went in to collect my cheque. Drop by in person, tell them you changed your mind, baby on the way, house to buy, parents to bail out of jail, etc. Be civil, be polite, yes sir...no sir. Be firm.

Let them produce a signed contract, no way you are on the hook. If anything they ought to give you interest on the money lent to them. Three months waiting for a car...not like it is a GT-R.

They will have no problem in selling the Fit you placed an interest in, these cars are selling.

The lawyer threat aside,
The dealer can't keep your deposit if you choose not to take delivery on the car. Dealers often ask for the deposit to make sure that you're serious about considering the car. It is a very popular car, and that's the point, if you're not serious about buying, their time is better spent on someone who is.

That said, if they order a certain trim for you, and you test drive it, and it's not what you're looking for, you are entitled to your deposit back. The point is to make sure you're serious. If you've given the car serious thought, or need a vehicle before they can get you one, you're well within your rights to call off the deal.

A good dealer should be more than happy to refund your deposit, and keep you as a customer or referral source in the long run.

More importantly, you didn't sign anything.
